Category : Indecency, Pornography
Case : Andhara Early vs FPI on Playboy Magazine's indecency case
Indictment : Article 282 of Criminal Code about indecency
Media : Indonesia Playboy Magazine
Celebrity involved: Andhara Early, Fla 'Tofu', Julie Estelle
Year : 2006 (from April 2006 until April 2007)
Here's The Case
The first edition of Indonesia Playboy magazine was published in April 7, 2006, featuring Andhara Early as its cover model.
Soon after its launching, the violent protest, especially from Front Pembela Islam (Islamic Defenders Front) or known as FPI, was hurled against the magazine office, the staff, as well as towards its model.
Based on the lawsuit filed by a group called the Indonesian Anti-Piracy and Pornography Society (MAPPI), the police launched an investigation into the magazine. Those who were investigated are:- Erwin Arnada, the Chief Editor of Indonesia Playboy magazine
- Andara Early, the Centerfold Model for the April edition.
- Kartika Oktavini Gunawan, the Playboy Mate for the April edition.
Due to anarchic protest in Jakarta, Playboy moved its office to Bali and continued to issue the 2nd and 3rd edition. Another lawsuit of indecency were charged to:- Xochitl Priscilla or popularly known as Fla ‘Tofu’ for her appearance in the 2nd edition and
- Julie Estelle for her pose in the 3rd edition.
The Lawsuit and its Journey
Andhara were called for the police questioning twice as witness. The questioning took place in Polda Metro Jaya on April 27, 2006. She was accompanied by her lawyer, Soesilo Aribowo, and had to answer 25 questions during the 3,5 hours investigations. She said that all questions were strictly about the Playboy magazine photo shooting and its chronology.
Another questioning was held on July 4, 2006, where she had to face 40 questions. She appeared calm and said that she didn't regret her decision for being a Playboy model.
In early 2007, Andhara Early along with Erwin Arnada and the other models (Kartika, Fla Tofu and Julie Estelle) were named as suspect by Polda Metro Jaya and their case files were said to be submitted to prosecutor. None of the suspects were being arrested because, as the City Police Officer said, the conviction threat were less than 5 years and their cooperative attitude during the investigation.
On January 18, 2007, Andhara and Fla Tofu testified as witnesses in the trial against Erwin Arnada in the South Jakarta District Court. As Andhara was leaving the court, the protesters from Islamic group who gathered outside were heard to call her "cheap prostitute" who would go to hell and said "I hope your daughter gets raped". Andhara stayed calm and did not respond to this insult.
How It Ends
On April 5, 2007, Indonesian judges acquitted Erwin Arnada of the charges with judge Efran Basyuning saying the pictures 'could not be categorized as pornography'. The judge said the prosecution had used the wrong law in its charges against Erwin. Because Playboy was a product of the press, it should use the Press Code (UU Pers) as the relevant law and not only the Criminal Code in its charge sheet. Erwin Arnada was therefore not convicted and set free.
No further report was told about the trial against Andhara Early following the verdict of Erwin Arnada. It maybe concluded that the based on Arnada's free verdict, the prosecution against Andhara Early and other Playboy model were not valid and was unlikely to continue.
Do you know?- The Indonesian Playboy Magazine did not show any nudity photography, unlike the ones published in other countries. The Islamic headliners' violent reaction toward Playboy magazine was mainly regarded of it being the symbol of western pollution to Islamic culture.
- Playboy trial is the first case amid the controversy over the antipornography bill, which was at that time being deliberated at the House of Representatives.
- In the aftermath of the trial and continuing rejection, Indonesian Playboy magazine went to bankruptcy and cease their publishing.
