Category : Drug Abuse
Case : Achmad Albar on Hiding Drug Fugitive and Ecstasy Possession
Indictment :
- Psychotropic Law No 5 of 1997 Article 62 on Illicit Drug Possession
- Criminal Code Article 221 on Hiding Fugitive
Year : 2007
Time Span : Arrested in September 26, 2007 and released on July 11, 2008
Verdict : Guilty as charged and sentenced to 8 months imprisonment
Here's The Case
On November 26, 2007, Ahmad Albar was arrested in his own house in Kedondong Street Block A No 220, Cinere, Depok. He was accused of hiding Jenny Chandra aka Cece, the drug fugitive of the earlier discovery of 490,000 ecstasy pills in Taman Anggrek apartment, West Jakarta. During the raid, the police also found an ecstasy pill in his bathroom and 0,3 gram heroin in his son's, Fahri Albar, room. Furthermore, the urine test also confirmed that Albar had consumed a psychotropic drug.
Albar was immediately held in custody since the raid and then he was moved to Paledang penitentiary on March 25, 2008 following the submission of his complete investigation files to Depok District Attorney. Corollary he was to face trial in Depok District Court; while his friend Cece was on different trial in West Jakarta District Court.
Albar's trials in Depok District Court was led by Zaenudin as the presiding judge and Budi Hartawan Panjaitan as the state prosecutor. The first trial was conducted on April 7, 2008, followed by a series of exhaustive trials on April 14, April 21, May 5, May 12, May 15, May 21, May 26, 2008. On June 5, 2008, Albar was prosecuted to 1 year confinement over the accusation of possessing illicit drug and hiding fugitive.
Responding to the accusations, Albar defiantly claimed that the ecstasy pill didn't belong to him and that he didn't know Cece was a fugitive as he merely helped her while she was looking for a rented house. He admitted that he once consumed shabu-shabu with Monash, Cece's husband, but insisted that now he had come clean.
He was represented by Togar M. Nero and Hery Subagyo as his lawyers. Another trial was held on June 12 and June 18, before the verdict reading at the end of June.
On June 25, 2008 Ahmad Albar was finally sentenced to 8 months in prison and IDR 6 Million in fine. The sentence was 4 months lighter than that prosecutor demanded. The incriminating factors were the facts that Albar, as a public figure, didn't set good example and didn't assist government program to combat drug abuse.
Albar's trials were often attended by his son, actor Fahri Albar, his step-sister, singer Camelia Malik, his so-called girlfriend Dewi Sri Astuti, some of his celebrities friends, and a group of Pemuda Pancasila.
How It Ends
Having being detained for 8 months since his arrest in late November 2007, Albar was finally released on July 11, 2008. The infotainment reporters were busy asking whether after his release, he would marry his suddenly disclosed girlfriend. He was 61 years old when the case happened to him. Pursuing his freedom, Albar continued his musical career and even received an award as legendary musician.
Ahmad Syech Albar, whose nickname is Iyek, was born in Surabaya on July 16, 1946. He was the lead vocal of Indonesian legendary rock band 'God Bless' and his trademark appearance is his big curly hair. Among his famous songs are “Panggung Sandiwara” (Drama Stage) and “Jangan Ada Angkara” (Let There Be No Wrath). He is the father of Fahri Albar, a rising young actor in Indonesian movie scene.

- 2nd Episode - Psychotropic Law No 5 Year 1997, primary article 71 verse (1) jo article 60 verse (2), subsidiary article 71 verse (1) jo article 62, and sub-subsidiary article 65
Here's The Case
A. Drug Abuse Episode I (February 2006 – October 2007)
Roy Marten was arrested on February 2, 2006 at 04:00 PM during a raid on a house in H. Buang II Street no 1, Ulujami, South Jakarta. Officers confiscated two small packages of crystal methamphetamine (shabu-shabu) weighing 2.6 grams. He was arrested together with his friend, Ilyas Jacob, who was also the owner of the house. He was represented by Chris Salam, who was his own brother, as his lawyer. The trial was held in South Jakarta District Court with Johanes Suadi as the presiding judge and Didik Farkhan as prosecutor.
Roy admitted in the court trial that the drug was his and expressed his deep regret. On May 29, 2006, Roy received the verdict of 9 months which was only half of the prosecutor's demand. He received an remissions and was released on October 1, 2007. Upon the release, Roy was appointed by BNN, the the National Drugs Law Enforcement Agency, as one of public figures to promote anti-narcotics campaign.
B. Drug Abuse Episode II (November 2007 – August 2009)
Roy was detained for the 2nd time in Novotel hotel in Surabaya on November 13, 2007. The police confiscated 1,5 grams of shabu-shabu, bong, scale and aluminium foil in room no 465. He was arrested together with his five friends: Fredy Matatula, Roy Hartanto aka Hong Kho Hay, Didit Kesit Chayadi, and Winda. Ironically, it happened three days after he gave a testimony during the signing of an anti-drugs joint agreement between BNN and the Surabaya-based newspaper Jawa Post in Surabaya.
Due to this recurrent case, Roy underwent a severe depression as the public hugely disdained him for deception and humiliation of the anti-narcotic campaigns. His trial was held in Surabaya District Court with Berlin Damanik as the presiding judge and Adi Wibowo as prosecutor. Roy was represented by Sunarno Edy Wibowo as his lawyer.
On April 12, 2008, Roy was sentenced by a Surabaya court on Friday to three years in jail and a fine of Rp 3 million for using illegal drugs. The sentence was six months lighter than that demanded by prosecutors as the defendant was found guilty only of using and not selling the drugs. Roy objected the verdict, saying it is too long for a drug victim. Based on his family request, since August 2008 Roy served his sentence in Cipinang Penitentiary in Jakarta instead of Surabaya state prison.
How It Ends
After serving two-third of his sentence, Roy was granted a two-month remission and a parole on August 18, 2009 that allow him to have freedom sooner than the original sentence. During the parole, he must report himself monthly to the Cipinang Correctional Center and East Jakarta Judiciary until he was granted a full release in August 18, 2011. A reporting absence or re-misconduct will cancel the parole.
He was reported to call himself “more stupid than donkey, falling twice in the same hole”. He still received many job offers after this case.
Roy Marten is an Indonesian seasoned actor whose the cinematic heyday was in 1970's. His hit movie was “Cintaku di Kampus Biru” and “Ali Topan Anak Jalanan”. His real name is Wicaksono Abdul Salam and was born on March 1, 1952 in Salatiga, Central Java.
Do You Know?
Both Roy Marten's cases received enormous attention from infotainment industry. In the first episode in 2006, many infotainment shows 'stood by him' by speculating him being framed, in regard to his earlier dispute with the fellow actor, Anwar Fuady, on the corruption issue in PARSI organisation. As for the 2nd episode in 2008, the infotainment tried to offset his alleged crime by showing humanitarian theme about the fortitude of Roy's wife, ex-model Anna Maria.

Sheila Marcia: Young Life Twisted By Drug Abuse
Pretty and easy-going actress Sheila Marcia Joseph didn't think carefully enough when she entered Golden Sky apartment in August 2008 to have a 'shabu-shabu' party with her male colleagues. In her young age of 19 and emerging career, she must spend time in prison for illegal drug possession.
Category : Drug Abuse
Case : Sheila Marcia on Illegal Drug Possession and Use
Indictment : Psychotropic Law No 5 Year 1997 Article 62 jo 71 and Article 62 jo 55
Case Year : 2008
Time Span: Arrested in August 7, 2008 - Fully released on February 9, 2010
Here's the Case
Sheila was arrested on August 7, 2008 at the Golden Sky Apartment building in Pluit, North Jakarta with four other guys. The report said that they were having drug party and later on she was charged of possessing 0.27 grams of Shabu-shabu. Apart from the drugs, police also confiscated a bong and lighters.
The Law Process
The trial of Sheila's illegal drug possession was conducted in North Jakarta District Court. Sheila was represented by Mudarwan Yusuf as her lawyer. During the process, Sheila was always accompanied by her mother, Maria Cecilia Joseph.
The first trial was conducted on October 20, 2008. It was a hard case for her as there were some incriminating factors: she was caught red-handed and the other witnesses said that she indeed asked for the drugs herself.
On the trial dated November 17, 2008, Sheila was prosecuted for 2 years in prison and IDR 10 Million fine in lieu of 5 months confinement.
On December 15, 2008, Sheila received the verdict of 1-year confinement in Pondok Bambu penitentiary and IDR 5 Million in fine. Sheila and her lawyer then appealed to the High Court.
On March 5, 2009, which was 7 months after the first verdict, the North Jakarta High Court decided that the punishment for Sheila be reduced from 12 months to 'only' 7 months. Sheila team accepted the new verdict, however the prosecutor further appealed this case to Supreme Court.
Based on the appeal verdict from High Court, Sheila was released on March 6, 2009 after spending 7 months in jail.
How It Ends
Unfortunately for Sheila, the case didn't end yet. After her release in March 2009, Sheila was back in the show business by being a host in 'Inbox' music show and covering a Chrisye's hits song “Damai Bersamamu” (Peace Be With You). She was also engaged to a Balinese basketball player named Delano Ezar. It seemed the media loved Sheila and put her a lot in their infotainment news.
Sadly Sheila couldn't enjoy her freedom for too long. On September 7, 2009, after the Supreme Court granted the appeal of persecutor, she was forced to return to the prison to finish her remaining confinement period for 5 months. Her execution was quite dramatically as she was picked up by the North Jakarta District Court staffs at 3:30 AM in Bali. Sheila kept making news as at that time, she was 2-month pregnant out of wedlock and would not publicly reveal the name her baby's father. She only claimed that it wasn't Delano's.
Sheila will be again set free from Pondok Bambu jail on February 9, 2010.
Sheila Marcia Joseph was born on September 3, 1989 in Malang, Java. She was a model and starred in rather famous horror movies like Hantu Jeruk Purut and Kereta Hantu Manggarai.Do You Know?
Sheila's maternity due date is between February 24 – March 3, 2010. As she would have already been released at that time, she'd planed to give labor in Harapan Bunda Hospital, Pasar Rebo, East Jakarta that has appointed her as the Anti-abortion icon in December 2009.
The verdict of physical confinement for Sheila was considered unfair by the GANNAS Chairman (National Movement of Anti Narcotics and Psychotropics) as Sheila was merely a young user instead of a dealer and shabu-shabu was categorized psychotropics rather the narcotics. They said it would be more appropriate to apply the rehabilitation punishment for such case.

Isabel Yahya: It's Art, Not Nudity!
Isabel Yahya was one of Indonesian top models. Clearly she has been accustomed to high level fashion and can very well differentiate art from pornography. But not all people shared her professional mind. Together with her co-model Anjasmara, she was entangled in controversy with a radical front due to her semi-naked photo in 2005 CP Biennale exhibition.

Case : Isabel Yahya vs FPI on Nude Photography in CP Biennale Exhibition
Indictment : Article 282 Criminal Code on Indecency
Year : 2005
Time Span : Begun in September 2005 and ended in November 2006
Here's the Case
The 2005 CP Biennale exhibition with “Urban Culture” theme toke place in the Bank of Indonesia Museum, displaying various art installations and digital photography. One of the artwork, called “Pink Swing Park” showed Anjasmara and Isabel Yahya appearing almost nude in a park, mirroring the image of Adam and Eve in paradise. The installation that was photographed by Davy Linggar drew violent protests from "Islamic Defenders Front” (FPI). The exhibition that was supposed to held for one month from September 5 – Oktober 5, 2005 was then abruptly closed in September 27, 2005.
The Lawsuit and Its Journey
The Islamic Defender Front originally intended to report the case on the basis of pornography and religious disgrace as the photo was interpreted as blasphemy towards the prophet Adam A.S and Siti Hawa. The official lawsuit however was mainly about the indecency case which were filed by the FPI in October 2005, against:
Anjasmara, as the model
Isabel Yahya, as the model
Davy Linggar, as the photographer
Agus Suwage, as the idea originator
-
Jim Supangat, as the founder and chief curator of CP Biennale foundation
Police investigation was done on Februari 16, 2006 against Isabel Yahya in Polda Metro Jaya.
She was accompanied by her lawyers, Todung Mulya Lubis and Lelyana Santoso, and was asked 34 questions for 2 hours regarding the chronology of the controversial photo shoot. Todung Mulya Lubis Law Office also acted as the lawyer for Davy Linggar, Agus Suwage and Jim Supangat, while Anjas was represented by another lawyer.
Anjasmara was then known to come to FPI headquarters to publicly apologize, but his co-model Isabel Yahya didn't. Abel, the nickname of Isabel Yahya, however once came to Nadhatul Ulama's main office in Kramat Jati, Jakarta to ask support from Gus Dur in March 16, 2006. Gus Dur himself was not available to see her at that time due to his hospital treatment. His remark on this whole case was the famous “Gitu aja diurusin!” (Why bother this thing!) Overall, Abel remained on her point that she only did her job as a model professionally and the photo was indeed a piece of art.
In November 24, 2006, Polda Metro Jaya declared that investigation against Anjas is terminated. Isabel's lawyer further concluded that this should mean the whole case did not adequately meet the requirements. After the case, Abel still received many job offers and thus intended to stay active in modeling world.

Anjasmara's Naive Nudity in CP Biennale Exhibition
Anjasmara was on the top of his career as an actor when he agreed to participate in a supposedly artful and limited exhibition of 2005 CP Biennale. Had he never imagined his striking pose in the Pink Swing Park would draw violent protest from a radical front and cause him much depression.

Anjasmara, as the model
Isabel Yahya, as the model
Davy Linggar, as the photographer
Agus Suwage, as the idea originator
Jim Supangat, as the founder and chief curator of CP Biennale foundation
Anjasmara was reported to deal with a lot of stress due to the lawsuit. On October 17, 2005, during the fasting month, Anjas went to FPI headquarters and publicly apologized for the controversial photo. Anjas claimed that:- The photo was planned to be displayed for limited audience only and not for public view
- He did not received any honorarium for his participation as it was intended for non-commercial use
The apology was well accepted by the Islam Defenders Front, but the law process was uninterrupted.
Anjasmara and Isabela Yahya still had to attend the police investigation in Polda Metro Jaya on February 3, 2006 which took 2,5 hours. Afterwards, they both were named as suspects and face the threat of 1 year in prison. He was not held in detention due to this new status, but it has depressed him enough. A report said that due to his disappointment with his then lawyer, Elza Syarief, he decided to hire a new one, Yan Mustafa Amir, who was known close to FPI.
How It Ends
Anjas was quite relieved when FPI dropped all charges against Anjasmara as the continuation of their peace agreement in the fasting month.
In November 24, 2006, Polda Metro Jaya issued the SP3 which basically put the investigation agains Anjas into an end. After the case, Anjasmara hardly seen in public or act in TV shows. He chose to work behind the scene and focus on his family life.
Anjasmara Prasetya is an actor and model, born in Blitar, East Jawa, on November 13, 1975. He is most well-known in his role as a mental-retarded boy name Cecep in TV comedy “Wah Cantiknya!!”
Do you know?
In the aftermath of this case, the CP Biennale exhibition was decided to be terminated for good. This was announced by Jim Supangkat as the Chief Curator, in the pers conference on September 27, 2005. The underlying reasons were:
The exhibition has sparked unintended controversy on pornography and misinterpretation.
To protect the BI Museum as one of historical site from destruction.
With the Anjasmara-Isabel case, the original goal of the exhibition was clearly unachievable.
